The Judge Was so Disturbed, He’s Keeping the Boy in Jail Until Trial

A Miami-Dade judge has ruled that 15-year-old Xavier Tyson, one of three teenagers accused in the brutal attack of a 12-year-old girl in Overtown at the Green Haven Project location, will remain held without bail until his trial. During a court hearing on Friday, Tyson’s defense attorney aggressively fought for his release on bond, presenting character witnesses to paint a vastly different picture of the teen.

His aunt and legal guardian described him as a respectful, loving, and non-violent child, while a founder of the Overtown community garden, where the crime occurred, testified that Tyson had previously been a “poster child” and a well-known face for their local youth programming. Despite these appeals, the judge expressed severe discomfort with the idea of releasing him back into the community, citing the disturbing nature of his alleged role in the crime and ruling that public safety warranted his continued detention.

The Details of the Attack

The background of this case traces back to last summer, when a 12-year-old girl was subjected to a horrific, 30-minute assault at a community garden in the Overtown neighborhood of Miami. According to police reports and court testimony, the victim was attacked by three minors.

The victim told investigators that 13-year-old Nelson Nunez was the primary assailant who allegedly raped her, while Tyson and another 13-year-old boy, Jusiah Jones, actively held her down to prevent her escape. As the young girl repeatedly screamed for them to stop, the boys allegedly stuffed small, beige, pebble-like rocks into her mouth, threatening to force even more down her throat if she did not stay quiet.

During Friday’s hearing, Tyson’s defense attorney highlighted apparent discrepancies in the initial police reports, noting that the victim’s earliest statements did not accuse Tyson of touching her breasts or removing her clothing. The defense argued that these details raised serious questions about the extent of his involvement.

However, prosecutors maintained that his alleged role in physically pinning the victim down and silencing her made him an active participant in the heinous group attack. Because of the extreme severity of the crime, all three minors are being charged as adults. The judge has expressed a strong preference to fast-track the proceedings and have the case go to trial before the end of the year, with a formal status conference scheduled for next week to determine the timeline.
