Indictment: DOJ Selectively Prosecuting James Comey at Trump’s Request

Trump DOJ Indicts James Comey: A Political Hit Job Disguised as Justice

“This isn’t law enforcement it’s political revenge. Trump’s DOJ has turned the Justice Department into his personal hit squad.” – Patrick Zarrelli

The Indictment

Former FBI Director James Comey has been indicted on two federal charges, making a false statement and obstruction of justice, tied to his 2020 Senate Judiciary Committee testimony on Russian interference in the 2016 election. If convicted, he faces up to five years in prison, though federal sentencing guidelines typically deliver less than the statutory maximum.

At first glance, it reads like a technical perjury case. But the context tells a darker story. This indictment comes only days after Donald Trump publicly demanded his Justice Department “act now” against Comey, New York Attorney General Letitia James, and other political enemies. The indictment isn’t a coincidence. It’s a political weapon, aimed squarely at one of Trump’s most outspoken critics.

Trump’s Purge and a Loyalist’s Rise

The case only moved forward after Trump orchestrated a wholesale purge inside the Department of Justice.

  • U.S. Attorney Erik Siebert, who resisted bringing flimsy charges against Comey, was ousted.

  • Trump then installed Lindsey Halligan, his former personal defense attorney and a White House aide, as U.S. Attorney for the Eastern District of Virginia. She has zero prosecutorial experience.

  • Career prosecutors in the office had already written memos recommending against indictment, citing lack of probable cause. Halligan ignored them, shopped the case to a grand jury, and got the charges Trump demanded.

This isn’t how the Justice Department is supposed to function. Prosecutorial discretion exists to shield justice from political manipulation. Here, it was bulldozed.

A Transparent Retaliation Campaign

Trump has been clear about his motives. In social media blasts, he celebrated Halligan’s appointment as the person who would “get things moving” against Comey. He publicly attacked Siebert for his reluctance and demanded prosecutions. Within days, Comey was indicted. This is not subtle. This is not hidden. This is open retribution, a president using the power of the Justice Department to punish those who crossed him.

Critics call it selective prosecution. The truth is uglier: it’s weaponized prosecution.

Why It Matters

This case isn’t about whether James Comey shaded an answer before Congress five years ago. It’s about whether the United States will tolerate a president who uses criminal law as a political cudgel.

  • Judicial independence is on the line. If courts let this stand, it signals that prosecutions can be ordered from the White House like a fast-food menu.

  • DOJ credibility collapses. Once seen as an impartial institution, the Justice Department is now in danger of becoming an enforcement arm of the executive branch’s grudges.

  • Democracy erodes. If political enemies can be indicted at will, opposition voices will be chilled, watchdogs silenced, and the balance of power shattered.

Comey’s Likely Defense

Comey’s attorneys have not yet responded, but his defense writes itself: this is political persecution, not legitimate prosecution. He will likely cite the DOJ’s own declination memo, the unprecedented appointment of Halligan, and Trump’s public statements as evidence that this case was manufactured from the top down. In a functioning system, the indictment would be tossed. But with Trump’s allies reshaping the federal bench, the outcome is anything but certain.

What Does This Say About America?

The Comey indictment is not about justice, it’s about power. It’s the clearest example yet of Trump dismantling the wall between politics and law enforcement, and using indictments as instruments of revenge. America has seen strongmen abroad do this for decades. Today, it’s happening here. The real question is not whether James Comey is guilty of lying in 2020. It’s whether America is willing to accept a justice system that serves one man’s vendettas.
