While they are awaiting trial, they are considered to have pending criminal charges against them, and this status disqualifies them from legally purchasing a firearm.

It’s important to note that this prohibition is not limited to individuals who have been convicted of a crime but also extends to those who are in the pre-trial phase. The rationale behind this restriction is to prevent individuals who may pose a potential risk to society from acquiring firearms during the legal process.

It’s worth mentioning that firearm laws can vary by state, and some states may have additional restrictions or requirements related to gun purchases. Additionally, there are potential consequences, both legal and practical, for attempting to purchase a firearm while under indictment, including potential charges of perjury or making false statements on the background check forms.
