Miami Attorney Accused of Violently Taking Down 67-Year-Old Cruise Passenger, Bystanders Forced to Perform CPR After Victim Lost Pulse

A Miami Lakes attorney is facing serious criminal charges after a brutal confrontation aboard a Norwegian Cruise Line ship left a 67-year-old passenger unconscious, pulseless, and in need of emergency CPR, according to arrest records and sworn testimony. The incident, captured on cruise-ship security cameras, has now triggered an FBI investigation and renewed scrutiny of violence on large cruise vessels.

A Dispute Over a Closed Hallway Turned Into a Violent Assault

According to the arrest report, the attack unfolded aboard the Norwegian Encore after the elderly passenger told attorney Phillip Ortiz, 38, that he could not enter a restricted hallway that wasn’t open to guests. Ortiz allegedly snapped back, yelling, “Who the [expletive] are you to tell me what I can and can’t do?” before pushing the older man.

A woman traveling with Ortiz then also shoved the victim, prompting the victim to push her away. That escalation reportedly sent Ortiz into a rage.

The victim attempted to retreat into the hallway and close the doors to block Ortiz from returning, but Ortiz allegedly forced them open and charged. During the struggle, authorities say Ortiz leg-swiped the 67-year-old, knocking him backward and falling on top of him with full body weight. The victim struck his head and immediately lost consciousness.

Witnesses told investigators Ortiz walked away without offering aid.

Victim Had “No Pulse” Until Passengers Performed CPR

According to the report and testimony in court, bystanders on the ship found the elderly man unresponsive and without a pulse. Passengers and shipboard medical staff had to perform CPR until the victim regained consciousness. He was later transported to the University of Miami Hospital for treatment of head trauma and a concussion. Security footage reviewed by police reportedly corroborated the victim’s and witnesses’ accounts.

Ortiz Confronted Police, Refused to Cooperate, and Tried to Return to the Victim

Miami-Dade officers located Ortiz on the ship, but he allegedly refused to sign a Miranda form or speak with detectives. Authorities say he then attempted to return to the scene, and to the victim, “to continue his aggression,” according to the police report.

Ortiz was taken into custody and booked into the Turner Guilford Knight Correctional Center. In court, his defense team pushed back, suggesting the victim had earlier placed hands on Ortiz’s wife. A deputy testified that video showed only “minor contact,” not evidence of bruising or injury. A judge ultimately ruled there was probable cause for battery on a person 65 or older, but not aggravated battery, noting the victim did not appear to have permanent injuries.

Ortiz was granted bond with strict conditions: no contact with the victim and mandatory stay-away orders.

FBI Steps In, Florida Bar Reviewing Attorney’s Status

Miami Police confirmed the FBI is now investigating the incident, which occurred in international waters where federal jurisdiction applies. Ortiz, admitted to the Florida Bar in 2012, remains eligible to practice law. Bar officials have not yet announced disciplinary action. Norwegian Cruise Line did not immediately respond to requests for comment.

The victim, who spent part of the voyage clinically pulseless after the alleged attack, is recovering, but the case is far from over. Federal prosecutors now have to determine whether a Miami attorney turned a cruise corridor into a near-fatal crime scene.
