Lawsuit Filed Against Actor and Management

Will Smith and his management company are facing a lawsuit from violinist Brian King Joseph, who performed on Smith’s “Based on a True Story: 2025” tour. Joseph claims he was retaliated against and wrongfully terminated after reporting what he believed to be sexual harassment and a safety violation. The complaint, filed on December 30, 2025, in Los Angeles County Superior Court, seeks damages for sexual harassment, wrongful termination, retaliation, and emotional distress.

Incident During Las Vegas Tour Stop

According to the lawsuit, the alleged incident occurred in March 2025 at a hotel in Las Vegas arranged by tour management. Joseph says he returned to his hotel room to find evidence someone had entered without consent, including a handwritten note, unfamiliar personal items, and a bottle of HIV medication with another person’s name. The note reportedly suggested a potential sexual threat, leading Joseph to contact hotel security, local police, and tour leadership.

Alleged Retaliation and Termination

Instead of receiving support, Joseph claims he was accused of fabricating the incident. He says he was then informed that the tour was “moving in a different direction,” effectively ending his employment. The lawsuit notes that another violinist was quickly hired to replace him, which Joseph frames as evidence of retaliation.

Claims of Emotional and Professional Harm

The legal filing asserts that Joseph suffered emotional distress, economic loss, reputational harm, and psychological trauma, including symptoms consistent with post-traumatic stress disorder, as a result of the alleged retaliation and mishandling of his complaint. He is seeking unspecified compensatory and punitive damages.

Response from Smith’s Legal Team

A lawyer for Smith, Allen B. Grodsky, described the claims as “false, baseless, and reckless”, and said the legal team intends to defend Smith vigorously. No additional public statements have been issued by Smith or his representatives.
