Have you ever drunk dialed somebody? Have you ever drunk walked into the kitchen to make a snack? Some of us have, and maybe some of us haven’t. Well, add a new one to society. Drunk DoorDash Ordering! That is what is at the crux of this whole ordeal. And it is quite an ordeal, because it involves nudity, harassment, he said/she said, and possible jail time for the delivery driver.
What Happened with this DoorDash Driver?
Olivia Henderson, 23, a New York DoorDash driver, is accused of filming and posting a TikTok video of a passed-out naked customer and has been indicted. Prosecutors say Henderson recorded the man asleep on his couch without pants by filming through his front doorway.
The video, which showed the man inside his home, quickly went viral, garnering nearly 30 million views before it was removed.
She appeared in Oswego County Court on Friday after a grand jury voted to move forward with felony charges tied to the viral video she recorded during a 2025 delivery. Through her attorney, Henderson pleaded not guilty. She was released as the case proceeds and is due back in court in June. Her felonies could land her in prison for up to eight years.

Court documents accuse Henderson of “degrading” the victim by recording “intimate parts of such person at a place and time when such person has a reasonable expectation of privacy, without such person’s knowledge or consent.”
Henderson (lied) claimed the encounter amounted to sexual harassment and filed a police report after posting the video.
“My customer requested that my order be left at their front door, and when I arrived at their house, their front door was wide open, and they were within eyesight of the front door, laying on the couch, indecently exposed to me,” she said in the TikTok video.
When they looked further into the details, investigators determined the man was passed out drunk inside his home and had not interacted with Henderson. It was just not possible for him to do what she claimed.
What is Next for the DoorDash Driver?
As a result, Henderson was arrested and charged with one count of unlawful surveillance in the second degree and one count of dissemination of an unlawful surveillance image in the first degree. She is pleading “not guilty”.
At Friday’s arraignment, Oswego County Judge Armen Nazarian did not allow cameras in the courtroom. Henderson declined to comment when approached by reporters outside the courthouse.
DoorDash previously said her account was deactivated following the incident.
“Posting a video of a customer in their home, and disclosing their personal details publicly, is a clear violation of our policies,” the company said.
“That is the sole reason that this Dasher’s account was deactivated, along with the customer’s, while we investigated.”
Henderson remains free without bail as the case moves forward. If convicted, she faces up to eight years in prison.
What are the Sordid Details of this Case?
The drunken DoorDash customer at the center of a viral TikTok video that had more than 30 million views, which showed him passed out half-naked on his couch, said the ordeal left him “humiliated”.
“I do not remember ordering it, but I must have fallen asleep on the couch afterward,” he stated. “While sleeping, I was naked from the waist down but still had my shirt on.”
The young man said that when he awoke, he saw a photograph that indicated the grub was delivered, but also showed “me naked on the couch.”
“This made me feel unsafe, humiliated, and upset. She also posted my first name and my house number,” he claimed. “I did not give permission for any photo or video to be taken of me or posted online. I want all applicable charges pursued.”
Police said investigators determined “the male was incapacitated and unconscious on his couch due to alcohol consumption” when the video was shot outside his home.
Did the DoorDash Driver Lie?
Henderson insisted in a lengthy statement to police that she was the victim in the scenario, saying the door was open when she arrived to drop off the delivery.
She stated she saw the customer lying on the couch with his arm over his face, so it was difficult to see his eyes, the police report states.
“He may have been sleeping, but I could not tell from outside,” she claimed.
“I observed that he was wearing a hoodie, but his pants and underwear were down around his ankles, leaving his genitals exposed. More specifically, I could see the tip of his penis from outside the residence.”
Henderson claims she took a video of the drop-off showing the man in the background. A video of each order better protects her against accusations that she did not deliver food, she said.
She claimed she reported the incident to police, and later ranted about it on TikTok, because she “did not want any other female delivery drivers to experience what I did.”
“Additionally, being a female delivery driver can be dangerous, and it is important to report these dangers,” she argued.
“The reason I felt unsafe was due to the potential of escalating behavior,” Henderson continued.
“More specifically, if he did this to me and caused me to feel this way, I thought he might do something worse to the next delivery driver.”
She clearly violated this guy’s rights in some way. She may have tried to find a loophole, but failed at that. This case is very reminiscent to me of the creepy guys who filmed “candid porn” or “up the skirt” porn with unsuspecting women in public. If you don’t have their signed consent, you are basically ass-out. Maybe she didn’t know that. But she’s gonna learn the hard way. Is she gonna land in jail? I highly doubt that. The legal problems and her name being ruined may have to suffice.
