Texas Man Arrested After Allegedly Attacking Hard Rock Cafe Employee at Bayside Marketplace, Police Say
MIAMI, Fla. — A Texas man accused of violently attacking a 21 year old Hard Rock Cafe employee at Bayside Marketplace after a dispute over drink garnishes has been arrested, bringing a swift conclusion to a manhunt fueled by viral surveillance video and a public tip.
Miami police announced Friday that Daniel Ramirez, 47, of Lubbock, Texas, was taken into custody at a Royal Caribbean cruise terminal at PortMiami after investigators identified him through a Miami-Dade Crime Stoppers tip. Ramirez now faces a felony battery charge stemming from the July 26 assault that left the employee with a concussion, a chipped tooth and other injuries. Authorities emphasized that Ramirez is accused of the crime and remains presumed innocent unless proven guilty in court.
Arrest Made at PortMiami
According to Miami police, U.S. Customs and Border Protection officers encountered Ramirez at PortMiami around 6:40 a.m. Friday and alerted city detectives. Investigators said Ramirez made an unsolicited comment that he had “run into a lady” before declining to answer additional questions once Miami officers arrived. He was booked into the Turner Guilford Knight Correctional Center, where bond had not yet been set as of Friday afternoon. Police have not said whether Ramirez was attempting to board a cruise ship, disembarking from one or simply present at the terminal.
Confrontation Began Over Drink Garnishes
According to the arrest report, the incident began Sunday evening when Ramirez allegedly entered an employee-only area behind the bar inside the Hard Rock Cafe at Bayside Marketplace and began eating fruit garnishes intended for customers’ cocktails. The employee told investigators she informed Ramirez that he was not permitted in the restricted area and could not handle garnishes that would later be served to customers.
According to police, Ramirez became confrontational and questioned what she expected him to do with the fruit already in his hand while directing profanity toward her. The bartender later explained that the garnishes were intended for drinks being served to guests and could not be touched by customers.
Complaint Escalated the Situation
Police say Ramirez returned to his table after the confrontation, where he was seated with his wife and four other people. According to the arrest report, he later complained to management, allegedly stating that no woman was allowed to tell him what to do and insisting the employee should be reprimanded.
The employee told investigators that a manager called her back and instructed her to pretend she was being disciplined in an attempt to calm the increasingly agitated customer. Surveillance Video Captured the Attack
Approximately 30 minutes after the initial dispute, surveillance cameras reportedly captured Ramirez approaching the employee. Police allege Ramirez shoved the woman with both hands, causing her to fall backward into a metal rack. The impact reportedly caused her to strike her head and chip one of her front teeth. The employee later told investigators she observed what she described as a look of “pure anger” immediately before the shove.
Second Confrontation Left Employee Unconscious
After the initial incident, the employee began photographing Ramirez with her cellphone as he walked away. According to police, Ramirez turned around, knocked the phone from her hand and pushed her in the face, causing her to fall a second time and briefly lose consciousness. The employee later told reporters she believed Ramirez struck toward her face with a closed fist, although investigators have described the second contact as a push. Portions of the encounter were reportedly obstructed by a structural pillar in the surveillance footage, making the precise nature of the contact difficult to determine from the video alone.
Employee Suffers Serious Injuries
The 21-year-old employee reported suffering:
- A concussion
- A head injury
- A chipped front tooth
- Temporary loss of consciousness
- Emotional trauma
- Anxiety about returning to work
She has publicly stated she does not intend to return to the restaurant because she no longer feels safe and expects to seek counseling following the incident. Speaking after Ramirez’s arrest, she said she was relieved police had identified the suspect and hoped he would reflect on how he would feel if someone treated a member of his own family in a similar manner.
