House Democrats Accuse Kash Patel’s FBI of Acting as Republican “Errand Boy” in Texas Political Standoff
“Federal law enforcement exists to fight crime and protect public safety — not to serve as a partisan tool for political crackdowns,” wrote House Democrats in a sharply worded letter to Attorney General Pam Bondi and FBI Director Kash Patel this week.
The letter, led by Rep. Robert Garcia (D-Calif.), ranking member of the House Oversight and Government Reform Committee, and Rep. Jamie Raskin (D-Md.), ranking member of the House Judiciary Committee, accuses Patel’s FBI of misusing federal public safety resources to assist Texas Republican leadership in tracking down Democratic state lawmakers who fled the state to block a partisan redistricting bill.
Joining Garcia and Raskin were Texas Democrats Rep. Greg Casar and Rep. Jasmine Crockett, who signed onto the formal demand for answers. Their warning followed reports confirmed publicly by Sen. John Cornyn (R-Texas) that the FBI is working alongside the Texas Department of Public Safety (DPS) to locate the absent lawmakers.
Federal Muscle in a State-Level Political Fight
Cornyn, who is lagging in the polls ahead of a 2026 GOP primary challenge from Texas Attorney General Ken Paxton, told reporters on July 31 that he had asked the FBI to help DPS identify and track down Democrats who left Austin to block what critics say is an extreme and undemocratic redrawing of congressional maps.
House Democrats argue that this is not just bad optics it is an abuse of federal authority. The letter cites legal precedent from a 2003 Texas state court ruling, which found that DPS had no authority to apprehend lawmakers for breaking quorum. That decision came during a similar standoff when Texas Democrats fled the state to block another Republican redistricting effort.
At the time, then-House Majority Leader Tom DeLay (R-Texas) was reprimanded by the House Ethics Committee for urging federal agencies including the Federal Aviation Administration and the Department of Homeland Security to track a plane carrying fleeing Democrats.
Kash Patel’s Role Under Fire
Kash Patel, a longtime Trump loyalist now leading the FBI, has been accused by critics of turning the bureau into a political weapon for Republican leadership, including Texas Gov. Greg Abbott and President Donald Trump. Patel’s tenure has already drawn scrutiny for politicizing investigations, and this latest episode has fueled accusations that he is acting as a Republican “errand boy” rather than a nonpartisan law enforcement official.
“The reports that federal agents are being used to chase down political opponents in a state dispute are deeply troubling,” the lawmakers wrote, warning that such actions divert resources from combating terrorism, drug trafficking, and other serious federal crimes.
Demands for Transparency
The Democratic lawmakers have asked the Justice Department and FBI to provide:
Written confirmation of whether they have agreed to assist Texas DPS in locating the lawmakers.
A complete accounting of personnel assigned to the effort.
The legal authority being cited for federal involvement in what is fundamentally a state political matter.
All communications between DOJ, FBI, and Texas officials regarding the operation.
Both the DOJ and FBI have so far avoided answering these questions. The FBI declined comment, and the DOJ did not respond to requests from multiple news outlets. Legal experts and civil rights groups have already criticized Cornyn’s request and Patel’s apparent cooperation, warning that it risks criminalizing political protest and undermining the separation between law enforcement and partisan politics.
This escalating standoff is more than a fight over redistricting it’s a high-stakes battle over whether the nation’s top law enforcement agency will remain independent, or whether it will serve as an extension of partisan political power.
